2. Your account
2.1. Your Information
All information provided by you when you register for the Service Victoria Platform must be valid and correct.

We may suspend accounts registered with another person’s email address, or with a temporary email address, without notice.

You must ensure that the Service Victoria Platform is kept secure from unauthorised access, use or modification, including by keeping your Login Details secure, secret and confidential.

2.5. Unauthorised access

3. Your use of the Service Victoria Platform
3.1. Access to the Service Victoria Platform
We authorise you, on a non-exclusive, non-transferable, revocable basis, to access and use the Service Victoria Platform, but you must comply with these Terms and any additional licences you may enter into in your use of the Service Victoria Platform.

3.2. Distributing material

We may impose additional terms and charges for that use.

We may, at any time and without notice to you:
(a) discontinue or modify any aspect of the Service Victoria Platform (including its functionality) without notice;

(c) remove any API.

5. Suspension and termination of your account or access to the Service Victoria Platform
5.1. Suspension of access
We may, at any time:
(a) refuse to register you for any reason
(b) suspend your access;
(c) cancel or delete your access;

(e) limit your access to the Service Victoria Platform - including by suspending, terminating or restricting your access to any APIs available on the Service Victoria Platform, without liability, including if you are in breach or we suspect you are in breach of these Terms, any API Licence Terms that apply to you, or any other agreement that you enter into with us (directly or indirectly).

5.2. No compensation

(b) comply with the Privacy Laws regarding your collection, use and disclosure of that Personal Information.

8. Intellectual property
8.1. Meaning of Intellectual Property
In these Terms, “Intellectual Property Rights” means all intellectual property rights including existing and future copyright, rights in designs, trademarks and patents, whether registered or unregistered, anywhere in the world.

8.8. Rights are exhaustive

9. Exclusion and limitation of guarantees
9.1. Exclusion of warranties
All express and implied terms, conditions, warranties and guarantees which otherwise might apply to, or arise out of, these Terms are excluded other than:

(b) guarantees which by law cannot be excluded or modified by agreement including those under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

9.2. Breaches of implied guarantees

9.3. Non-reliance

(a) you have not relied on any statement, representation, warranty, conduct or undertaking made or given by us or any person on our behalf, other than those expressly stated in these Terms; and
(b) you have relied on your own skill and judgment in deciding to acquire and use the Service Victoria Platform and the APIs and enter into these Terms.

9.4. Limitation on warranties
Subject to the liability position described above, we provide no warranty or guarantee and make no representation that the Service Victoria Platform or any of the APIs available on the Service Victoria Platform:
(a) will be uninterrupted, error free or available at all or any time;
(b) will be free from defects, or that any identified defects will be corrected;
(c) is fit for a particular purpose;
(d) will contain accurate, up to date or complete information;
(e) will be compatible with your hardware, software and other systems;
(f) will not impact the performance of other services, hardware, software and systems and those of third parties;
(g) will be secure from unauthorised access;
(h) will not contain any viruses or disruptive code; and
(i) will not infringe any person’s rights (including intellectual property rights).

Subject to your rights at law, we make no representation or warranty of any kind as to the accuracy, timeliness or completeness of the APIs, and any related datasets, nor do we endorse any APIs, and any related datasets, available on the Service Victoria Platform.

10. Liability
10.1. Limitation of liability
Except as expressly stated otherwise in these Terms:
(a) we are not liable for any loss or damage (including, without limitation, direct, indirect, special or consequential loss, loss of profits, loss of anticipated savings, loss of use, loss of reputation, loss of opportunity, loss of data or business interruption) suffered or incurred by you in connection with these Terms and the use of the Service Victoria Platform (including due to any person’s negligence), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law); and
(b) to the extent we are unable to exclude any liability under or in connection with these Terms, our maximum cumulative liability for all loss, damage, liability and expense suffered or incurred by you in connection with these Terms and your use of the Service Victoria Platform, whether under contract, statute, in tort (including negligence) or otherwise, is limited to $100.

10.2. Indemnity

11. Additional Terms for API consumers
11.1. API Consumer Terms
The terms in this section 11 apply to anyone who consumes, uses, accesses or integrates with any APIs in the Service Victoria Platform (Additional API Consumer Terms).

11.2. API Licence Terms
All APIs made available through the Service Victoria Platform are licensed under the Creative Commons Attribution 4.0 International licence (available at https://creativecommons.org/licenses/by/4.0/deed.en) and any additional terms of use and licence conditions applied by the API submitter (API Licence Terms). You will be notified of any API Licence Terms that apply to an API prior to your use of that API. You must comply with any API Licence Terms attached to any API that you consume. In the event of any inconsistency between these Terms and any API Licence Terms, the API Licence Terms take priority to the extent of that inconsistency.

11.4. Purposes for which you cannot use the APIs
You must not use the Service Victoria Platform or the APIs for the purpose of:

(c) creating a database of individuals for marketing purposes; or
(d) creating any application that is designed to, or has the potential to, harm any individual, government entity, or private organisation.

11.5. No endorsement
You must not republish the in a way that suggests to End Users that we, or any API owner, endorse you or your products or use of the APIs or datasets.

11.6. Your End Users
If you use the datasets from any API as part of a product that is available to third parties (End Users), you must require your End Users to comply with:
(a) all applicable State or Federal laws in connection with the use of the Service Victoria Platform;
(a) any reasonable directions given by us in relation to the use of the Service Victoria Platform;
(b) these Terms, including our Acceptable Use Policy below and Privacy Statement available at https://service.vic.gov.au/privacy-and-security ; and
(c) any API Licence Terms associated with the API(s) from which you obtained the datasets.

11.7. Notice on products incorporating APIs
You must include the following notice on any software, product, dataset or other material that incorporates or uses any API from the Service Victoria Platform:

This notice is to be included in addition to any notices required under any API Licence Terms. However, you must not use the APIs in a way that suggests to End Users that we, or any API owner, endorse you or your products or use of the APIs or datasets.

12. General
12.1. Survival
On termination or expiry of these Terms any provisions of the Terms which by their nature survive termination or expiry, continue in full force and effect.

12.2. Assignment and novation
We may assign or novate these Terms to any other person on written notice to you. You must not assign, novate or sub-license any of your rights or obligations under these Terms to any person without our prior written consent. Any purported dealing in breach of this prohibition is void and of no effect.

12.3. Governing law and jurisdictions
These Terms are governed by and are to be construed in accordance with the laws applicable in Victoria, Australia. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria and any courts which have jurisdiction to hear appeals from any of those courts and waive any right to object to any proceedings being brought in those courts.

12.4. Entire understanding
These Terms, our Acceptable Use Policy and the API Licence Terms contain the entire understanding between the parties as to the subject matter of this document. 12.5. Severability

12.6. Waiver
A single or partial exercise or waiver by a party of a right relating to these Terms does not prevent any other exercise of that right or the exercise of any other right. 13. Interpretation
13.1. Interpretation and construction
Unless expressed to the contrary, in these Terms:
(a) “includes” means includes without limitation;

(c) a reference to:
(i) a person includes a partnership, joint venture, unincorporated association, corporation and a government or statutory body;
(ii) a person includes the person’s legal personal representatives, successors, assignees and persons substituted by novation;
(iii) any legislation includes subordinate legislation made under it and includes that legislation and subordinate legislation as modified or replaced; and
(iv) this or any other document includes the document as novated, varied or replaced and despite any change in the identity of the parties.

The Service Victoria Platform
The Service Victoria Platform is this website. The Service Victoria Platform provides developers with tools and resources to access Service Victoria APIs. The Department of Government Services, Victoria (DGS, we, us) operates the Service Victoria Platform.
How this Acceptable Use Policy operates
This Acceptable Use Policy sets out how you may use the Service Victoria Platform and its APIs, in addition to the restrictions imposed by the Terms of Use (above). If there is any inconsistency between this Acceptable Use Policy and the Terms and Conditions, the Terms and Conditions will take priority to the extent of the inconsistency.
Changes to this Acceptable Use Policy
We may update this Acceptable Use Policy from time to time. Updates will be made available on this Service Victoria Platform website.
You must not undermine the security of the Service Victoria Platform
You must not:
(a) give the username, password or security keys you use to access the Service Victoria Platform or any API to any other person;
(b) allow any other person to access or use the Service Victoria Platform, except as authorised by us;
(c) use the personal information of another person in order to access or use the Service Victoria Platform;
(d) circumvent, or attempt to circumvent, the security measures and access protocols applied to the Service Victoria Platform or its APIs;
(e) damage, destabilise or compromise the security of information or technology of the Service Victoria Platform or any other person, business, government body or organisation;
(f) tamper with, hinder the operation of or make unauthorised modifications to the Service Victoria Platform; or
(g) interfere with or disrupt the integrity or performance of the Service Victoria Platform or any APIs, or servers or networks providing the Service Victoria Platform or any APIs.
You must not use the Service Victoria Platform for anything illegal
You must comply with all applicable laws when you use the Service Victoria Platform, including any Australian State or Federal law or any law of another country which applies to you, the rules of common law and equity, statutes, regulations, determinations, by-laws, ministerial directions, subordinate legislation, ordinances, mandatory codes, standards and guidelines, writs, orders, injunctions and judgements and any government or regulatory agency or authority requirement or authorisation (including conditions in respect of any authorisation).
You must not use the Service Victoria Platform, any APIs accessed through the Service Victoria Platform, or any data or information obtained from or associated with the Service Victoria Platform to:
(a) defame, abuse, harass, stalk, or threaten others;
(b) track or profile any individuals or make available data that allows for the tracking or profiling of individuals;
(c) distribute disruptive commercial messages or advertisements, or otherwise breach the Spam Act 2001 (Cth);
(d) create material that is misleading or deceptive, or otherwise mislead or deceive third parties;
(e) promote or facilitate unlawful online gambling;
(f) distribute viruses, trojans, worms, logic bombs or other material, code or program which is malicious or technologically harmful; or
(g) mount or attempt to mount a denial-of-service attack or a distributed denial-of service attack.
You must not use the Service Victoria Platform in any way that could harm the Victorian Government’s reputation
You must not use the Service Victoria Platform, any APIs accessed through the Service Victoria Platform, or any data or information obtained from or associated with the Service Victoria Platform in any manner that:
(a) could damage the Victorian Government’s good standing or bring the Victorian Government into disrepute; or
(b) misrepresents the Victorian Government or implies that the Victorian Government endorses you or any product you create using the Service Victoria Platform.
You must not use the Service Victoria Platform for inappropriate purposes
Data and information obtained from or associated with the Service Victoria Platform must not be used to create, send, access or store any form of data or information that:
(a) involves or could lead to victimisation, discrimination, harassment or vilification;
(b) is sexually suggestive, offensive, obscene, threatening, abusive or defamatory;
(c) may compromise the confidentiality, security or privacy of employees, persons, businesses, government bodies or other organisations (e.g. by re-identifying previously de-identified data or making it possible for others to do so); or
(d) impersonates or falsely claims to represent a person or organisation.
In addition, the Service Victoria Platform and data and information obtained from or associated with the Service Victoria Platform must not be used for any activities where the use or failure of the APIs could lead to death, personal injury, or environmental damage (such as the operation of nuclear facilities, air traffic control, or life support systems).
You must not use the Service Victoria Platform to infringe any third party intellectual property rights
You must not:
(a) use the Service Victoria Platform, any APIs accessed through the Service Victoria Platform, or any data or information obtained from or associated with the Service Victoria Platform to infringe the copyright or other intellectual property rights of any third parties;
(b) reverse engineer, decompile or disassemble or otherwise attempt to derive the source code of the Service Victoria Platform, any APIs or any part of the Service Victoria Platform unless you have express permission to do so; or
(c) remove any copyright, trade mark or attribution notices from the APIs or any other materials or data provided or made available to you in connection with the Service Victoria Platform.
You must not prevent other users from accessing the Service Victoria Platform
The Service Victoria Platform is a publicly available tool that is intended to be used by many users. You must not use the Service Victoria Platform or the APIs in a manner that:
(a) blocks access to the Service Victoria Platform for any other user;
(b) overloads the Service Victoria Platform such that the Service Victoria Platform or any part of the Service Victoria Platform cannot be accessed by other users;
(c) materially reduces the speed of the Service Victoria Platform for other users;
(d) has a detrimental effect on other users’ ability to use the Service Victoria Platform; or
(e) otherwise causes, or may cause, damage to the Service Victoria Platform or any impairment of the availability or accessibility of any part of the Service Victoria Platform.
